NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law.
The Mountain Survey Feedback Appreciation (“Promotion”) is sponsored by Sun Valley, LLC (“Sponsor”) with its principal place of business as 1 Sun Valley Road E, Sun Valley, ID 83353. These Official Rules govern the Promotion. A copy of these Official Rules is available at Sponsor’s principal place of business during regular business hours or by mailing a self-addressed, stamped envelope. The Official Rules will also be posted on our website at www.sunvalley.com/about/survey-rules/ during the Promotion Period. The Promotion begins on 12/1/2025 and ends on 4/30/2026 (“Promotion Period”).
1. Eligibility.
- The Promotion is offered to legal residents of and physically residing in the United States, excluding New York and Florida, and are at least 21 years of age or older (“Participants”). Employees, officers, directors, and managers of Sponsor, its parent, subsidiary, and affiliated companies and any other individual or entity who is engaged directly or indirectly in the development of, the production, distribution or review of materials for, or the administration, execution or implementation of this Promotion (collectively the “Promotion Entities”) and persons in the immediate family of such individuals (spouse, parent, child, sibling, partners and their respective spouses, and foster and step-relations) regardless of where they reside, or those living in their same household (whether or not related) as any person in any of the preceding categories are not eligible to enter or win a prize.
- Persons are NOT eligible to win more than one prize during the Promotion Period. This restriction also applies to immediate household members of Promotion prize winners.
2. Entry Process. Participants may enter the Promotion in two (2) ways:
- Online Entry: During the Promotion Period, the person entering the Promotion may enter beginning on the first of each calendar month at 12:01AM (MT) and ending on the last day of each calendar month at 11:59 PM (MT) (each an “Entry Period”). To enter online, Participants must follow the links and instructions delivered by email to enter the Promotion and complete and submit the online entry form (“Online Entry”) during the Entry Period outlined above. Online Participants are subject to all notices posted online including but not limited to the Sponsor’s Terms of Use and Privacy Notice
- Free Alternate Method of Entry Form ("AMOE"): To enter the Promotion without following the procedure set forth in Section 2(a) above, eligible Participants may send a 3” x 5” card with your name, email address (REQUIRED), phone number (REQUIRED), city and state of residence, and mail in an envelope to: Sun Valley Resort, 1 Sun Valley Road E, Sun Valley, ID 83353 (“Mail-in Entry” or “Mail-in Entries,” and together with “Online Entry” or “Online Entries,” collectively referred to as “Entry” or “Entries”). Mail-in entries must be received by the 30th of each month to be eligible for the drawing. To be eligible, Mail-in Entries must be postmarked from an address in the qualifying U.S. States. All Mail-in Entries must be handwritten. Mechanical reproductions will not be accepted. Proof of sending or mailing of Mail-in Entries will not be deemed to be proof of entry or proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, damaged, stolen, delayed, invalid, unintelligible, illegible, misdirected or postage-due Mail-in Entries, all of which will be disqualified. Receipt of Mail-in Entries will not be acknowledged. Mail-in Entries become Sponsor’s property and will not be returned.
- Participants are required to provide truthful information to the Sponsor in the Entries. Limit one (1) Entry per eligible Participant, regardless if Participant has more than one email address. Any Entry that does not include all content required herein, does not (in Sponsor’s sole discretion) appear to be compliant, submitted in good-faith, or that fails to follow all steps and include all other information required herein may be disqualified.
3. Entry Specifics.
- Entries must be complete, compliant, submitted via the method communicated, and timely received by Sponsor specific to the applicable Entry Period. Sponsor has the right to verify Participant’s eligibility and compliance with these Official Rules and, on the basis of its investigation, to disqualify any Entry at any time and require immediate prize return if applicable.
- By submitting an Entry, each Participant represents and warrants (and agrees to release and indemnify Promotion Entities from same) that the Entry submitted and all content therein is truthful and accurate. If requested by Sponsor, Participant shall provide evidence of the above in writing.
4. Prize Details. There will be only one (1) winner selected for each Entry Period during the Promotion Period as follows:
- One (1) prize will be awarded in accordance with these Official Rules, consisting of one (1) US$100 gift card to Sun Valley Resort.
- Sponsor, in its sole discretion, may award prizes to Entries received by alternate means. Sponsor will be the sole arbiter in all matters relating to the Promotion, including without limitation, contest Entries and in the interpretation of these Official Rules. The Sponsor assumes no responsibility or liability for damages, losses, or injury resulting from acceptance or use of the prize(s).
- Sponsor reserves the right to substitute a prize with another prize of greater or equal value. Prize(s) may not be redeemed for cash, substituted, transferred or assigned, except as may be determined by Sponsor at its sole and absolute discretion on a case-by-case basis. Winners (as defined below) are prohibited from selling any prize awarded or transferring any prize without the Sponsor’s authorization, which authorization must be in writing by a Sponsor representative and will be granted or withheld in the Sponsor’s sole discretion on a case-by-case basis. In the event that the Sponsor discovers or suspects (correctly or incorrectly) that a Winner is attempting to sell his/her prize from the Sponsor, the Sponsor reserves the right, in its sole discretion, on a case-by-case basis to take any one or more of the following actions: (i) immediately disqualify the Winner and deem any prize they were otherwise entitled to as forfeited; (ii) refuse to award the prize to such Winner, even if he/she represents that they will not resell or transfer the prize; and/or (iii) prohibit the violating Winner from participating and/or winning any future promotions, whether for a fixed period of time or in perpetuity, in Sponsor’s sole discretion, and if such Winner ever wins a future promotion during the period that he/she is banned, he/she will be disqualified from the contest and required to forfeit any prize once it has come to the Sponsor’s attention. Further, Sponsor reserves the right to track and/or cancel and invalidate any prize awarded that the Sponsor suspects was sold or transferred without authorization.
- All sales, prize and other local, county, state, and federal taxes, gratuities and any other incidentals associated with the prize are the sole responsibility of the Winner. The Sponsor assumes no responsibility or liability for damages, losses, or injury resulting from acceptance or use of the prize(s).
5. Winner Selection and Prize Pickup.
- The Winner will be selected in a random drawing from all valid entries received by Sponsor during each respective Entry Period during the Promotion Period. The odds of winning the Promotion will depend upon the number of Entries received during each respective Entry Period.
- Participants will win the prize upon confirmation of eligibility. To claim any prize, the person selected to win a prize (“Winner”) must provide valid government-issued photo identification and provide their complete address, date of birth, email address and phone number, and Social Security Number. Winner acceptance forms must be signed within 10 days of announcement of Winner or the prize will be forfeited.
- Sponsor may contact Participant(s), by phone, by email, by text message, by direct message or public post on social media network, and/or in person, as applicable. Sponsor will only be required to leave one voicemail message, send one email, send one text message, send one direct message on social media, and/or make one public posting on social media. Sponsor reserves the right, but not the obligation, to attempt to contact any Participants more than once, at its sole discretion, and will not be required to attempt to contact Participant(s) an equal number of times or in the same manner. Prize(s) will be released to Winners only.
- For the name of the prize winner during each Entry Period, Participants may send a self-addressed stamped envelope to: Sun Valley Resort, Attn: Marketing, 1 Sun Valley Road E, Sun Valley, ID 83353.
6. Cancellation. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Promotion should a virus, bug, computer or other problem beyond the control of the Sponsor corrupt the administration, security or proper execution of the Promotion.
7. Indemnification. By participating, Participants agree to the fullest extent permitted by law to release, discharge, indemnify, and hold harmless the Sponsor, the Promotion Entities, and the applicable social media platforms (the “Released Parties”) from and against any and all alleged and/or actual claims, causes of action, demands, losses, settlements (whether or not litigation is commenced, liabilities and damages of any kind whatsoever existing now or arising in the future (including, without limitation, bodily injury, personal injury, death, disability and property damage, violation of proprietary, publicity, privacy or any other right), costs and expenses (including, without, reasonable attorneys’ fees, court costs, settlement and disbursements) directly or indirectly arising out of use of the Entry in whole or in part, the acceptance, possession, use or misuse of a prize, participation in the Promotion and/or prize related activities, access to any platform or website, and/or any other participation in this Promotion. By entering and/or accepting a prize, Participants and Winners covenant to the fullest extent permitted by law not to sue the Released Parties or cause them to be sued regarding any matter released above, and not to disaffirm, limit or rescind this release. A waiver by one or more of the Released Parties of any term in these Official Rules does not constitute a waiver of any other provision. Any provision determined to be invalid shall be struck from these Official Rules and the remainder shall continue in full force and effect.
8. Miscellaneous.
- Applicable Laws. This Promotion is subject to all applicable federal, state, and local laws and regulations. By participating in this Promotion and/or acceptance of a prize, Participant agrees to comply with these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.
- Social Media Disclaimer. This Promotion is in no way sponsored, affiliated or administered by any social media platform or other platform used to advertise and/or facilitate the Promotion.
- Publicity. Subject to applicable law, entrance into the Promotion constitutes Participant’s consent for Sponsor and the Promotion Entities to use Participant’s name, voice, likeness, opinions, and biographical information for marketing and advertising purposes in any media throughout the world without obligation to seek consent or provide Participant with payment in any form of consideration.
- Force Majeure. The Released Parties are not responsible if any part of the Promotion cannot be conducted and/or if a prize, either in whole or in part, cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism, or other factors beyond the Released Parties’ control. Sponsor is not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by the Sponsor, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant’s ability to participate.
- Governing Law and Jurisdiction. These Official Rules shall be governed by the laws of the State of Idaho. Any disputes arising out of or related to this Promotion shall be subject to the exclusive jurisdiction of the state courts of Idaho.
- Limitation of Liability. In no event shall Sponsor or Promotion Entities be responsible or liable for indirect, incidental, consequential, or punitive damages, including without limitation lost profits, arising from Participant’s participation in the Promotion.
